PHIPA requires dental practices to implement administrative, technical, and physical safeguards to protect personal health information (PHI). This includes encrypting electronic patient records, restricting access to PHI on a need-to-know basis, maintaining audit logs of access to patient records, and having a documented breach response procedure. RCDSO additionally requires practices to maintain secure, recoverable backups of all electronic patient records.
Under PHIPA, dental practices must notify affected patients and the Information and Privacy Commissioner of Ontario when a breach creates a real risk of significant harm.
